1. Scope of services
HabitatOPS provides residential property operations and service coordination, including cleaning coordination, maintenance coordination, tenant support coordination, vendor coordination, building operations support, and the setup of related service workflows.
HabitatOPS does not provide real estate sales or brokerage services, mortgage or lending services, investment management or advisory services, or licensed property management in jurisdictions where such activities require a license. Clients are responsible for engaging appropriately licensed professionals for those needs.
2. Client responsibilities
Clients are responsible for providing accurate information about their properties, units, tenants, and service needs; granting necessary access for vendors and service providers; making timely decisions on scope, schedule, and approvals; and complying with all applicable laws relating to their properties and tenancies.
3. Quotes and payments
Every engagement begins with a written quote based on the size of the property, number of units, services required, and level of operational support requested. Work begins only after written acceptance of the quote.
Invoices are payable per the terms stated on each invoice. Late payments may pause active coordination until the account is brought current.
4. Service timelines
Timelines for coordination work depend on vendor availability, property access, and the scope of the engagement. HabitatOPS will communicate expected timelines and material changes in writing.
5. Third-party vendors
HabitatOPS coordinates with third-party vendors (cleaners, contractors, maintenance providers, and other service partners). These vendors are independent third parties, not employees or subcontractors of HabitatOPS.
HabitatOPS is not responsible for the quality, completeness, conduct, licensing, or insurance of any third-party vendor. Where appropriate, HabitatOPS will share vendor information so clients can make their own assessment.
6. Limitation of liability
To the maximum extent permitted by law, HabitatOPS' total liability arising out of or relating to the services is limited to the fees paid by the client to HabitatOPS in the three (3) months preceding the event giving rise to the claim.
HabitatOPS is not liable for indirect, incidental, consequential, or punitive damages, or for damages caused by third-party vendors, tenants, or events outside HabitatOPS' reasonable control.
7. Cancellations
Engagements may be cancelled in writing. Setup projects and one-time engagements may be partially or non-refundable depending on work already performed (see Refund Policy). Monthly support may be cancelled effective the end of the current billing period.
8. Website use
This website is provided for informational purposes. Visitors may not copy, scrape, or reuse the content without permission. HabitatOPS does not warrant that the site will be uninterrupted or error-free.
9. Governing law
These Terms are governed by the laws of the Province of Québec and the applicable federal laws of Canada. Any dispute will be brought before the courts having jurisdiction in Québec, Canada.
